After the residential housing market crashed in 2008, due mainly to the securitization of mortgage contracts, tens of thousands of Floridians lost their homes. Lenders, attorneys, and mortgage services fabricated documents in astounding numbers to facilitate foreclosures. The thousands of fabricated documents used by national banks and trusts, drew my firm’s attention to this area of the law. At first, the courts in Florida protected homeowner rights by disallowing reliance on the fabricated documents. Unfortunately, over the past 10 years, the homeowners’ rights in regard to these faulty documents have diminished greatly. Despite the change in jurisprudence, some case law survives that protects against actual fraud.
